To use LinkSense, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By creating an account, you represent and warrant that you meet these eligibility requirements.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include that organization.
LinkSense provides a dynamic link management platform that enables users to create, manage, and analyze smart links. Our Service includes the following core features:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately at support@linksense.net if you become aware of any unauthorized use of your account or any other breach of security.
We reserve the right to disable any account at any time if, in our sole discretion, we believe you have violated these Terms.
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair our Service. The following activities are strictly prohibited:
The Service, including its original content, features, functionality, and underlying technology, is owned by LinkSense and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks, service marks, and logos may not be used without our prior written consent.
You retain all rights to the content you create, upload, or transmit through the Service, including your dynamic links, project configurations, and associated metadata. By using the Service, you grant us a limited, non-exclusive license to host, store, and display your content solely for the purpose of providing the Service to you.
Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
Certain features of the Service require a paid subscription. Billing is processed securely through our payment partner, Paddle, which acts as the Merchant of Record for all transactions. By subscribing to a paid plan, you agree to Paddle's terms of service in addition to these Terms.
Subscription fees are billed in advance on a recurring basis according to the plan you select. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.
In accordance with Paddle's Buyer Terms, you have a 14-day unconditional right to cancel your subscription and receive a full refund from the date of purchase. For full details, please see our Refund Policy.
We reserve the right to change subscription pricing with reasonable notice. Any price changes will take effect at the start of your next billing cycle following the notice.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, LinkSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless LinkSense, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may cancel your account at any time by contacting us or through your account settings. If you have an active subscription, cancellation will take effect at the end of your current billing period.
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, providing additional notice (such as via email or an in-app notification).
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LinkSense operates, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the applicable rules of the jurisdiction.
